Automobile
RTT attorneys have a wealth of trial experience in the area of trucking and transportation law, covering more than half a century in duration. During this time, RTT attorneys have tried a wide range of civil cases to verdict in both state and federal courts of general jurisdiction including motor vehicle accident cases, wrongful death cases, prosecution and defense of declaratory judgment actions to resolve insurance coverage and other disputes, breach of insurance contract actions (including allegations of bad faith,) cases involving conversion and interference with property rights, Interpleader actions, and cases involving catastrophic injuries.

Bid Protests
RTT represents many bidders in filing bid protests before cities, towns, counties, an airport district, water and sewer districts, the state, universities, and other political subdivisions. Each political subdivision, unless it is a state entity, has its own procurement code or policy. Each protest requires great speed and a thorough understanding of the procedure that can only be gained by reading the procurement policy. Additionally, parts of the authority come from the State Engineer’s Office and the Procurement Review Panel, for which authority is not readily available in the sense of being published in an organized fashion. We have handled protests from the administrative agency all the way through the South Carolina Supreme Court.

Civil Litigation
The term civil litigation encompasses any litigation that is not pending in the criminal courts. RTT attorneys have a wealth of trial experience covering more than half a century in duration. During this time, RTT attorneys have tried a wide range of civil cases to verdict in both state and federal courts of general jurisdiction, including cases involving issues related to transportation, employment discrimination, premises liability, governmental tort claims, contract disputes, interference with property rights, wrongful death, conversion, and direct actions against insurance carriers and other corporate entities. Commercial and Business Litigation
RTT represents business organizations in disputes with other businesses and when they are sued by consumers. RTT litigators have handled a wide variety of commercial and business cases, including those involving unfair competition, breaches of warranty, fraud, commercial foreclosures, receiverships, bankruptcy claims (creditors only), UCC Article 3 check claims, wholesale automobile dealership claims, timeshare disputes and more. Community Association Litigation
RTT litigates an array of matters for community associations, from construction and assessment collection to zoning issues. Construction
RTT has represented general contractors, subcontractors, design professionals, developers, consultants, material suppliers, and manufacturers in many construction defect claims. We have handled single-family residence cases, cases brought on behalf of homeowners’ and condominium associations as well as by the class of owners, and we have handled commercial and industrial cases. Electronic Discovery
Following the December 1, 2006 revisions to the Federal Rules of Civil Procedure, discovery of electronically stored information (ESI) has become an increasingly important aspect of litigation. The attorneys of RTT appreciate and understand the key differences that separate traditional paper discovery and e-discovery. We work with our clients to develop organization-specific policies and procedures that will enable them to effectively respond to requests for ESI.

Employment Practices Liability
Tens of thousands of lawsuits are filed in federal court each year alleging civil rights violations of some kind. Of these, in a recent year, more than 24,000 were employment discrimination lawsuits against private employers. These numbers are expected to be even higher in the future. Many companies have turned to Employment Practices Liability Insurance (EPLI) to manage this risk. EPLI policies differ from Comprehensive General Liability (CGL) policies in several key ways. EPLI policies insure against liability arising from employment practices, while CGL policies insure against claims for bodily injury and property damage—that is, tangible damages. Furthermore, intentional acts, as commonly claimed in employment suits, and bodily injury to employees arising out of and in the course of employment or out of performing duties related to an employer's business typically are excluded under CGL policies. Environmental Litigation Defense
Environmental issues arising under federal or state law, such as CERCLA, RCRA, CAA, CWA and the South Carolina Pollution Control Act, can be both surprising and costly. Our Litigation Department can assist with enforcement actions and lawsuits, and our transactional department can assist with environmental issues that arise during development projects (such as testing and “brownfields” redevelopment).

Probate Litigation
